hi guys, looks like the board is still a `Charity` so does this mean that we can decide if we will `Donate` or not, cheers

hi guys, yes i believe they are but as Wal had mentioned before : how is a `charity`able to impose a tax on tradesmen? i think we need legal advice,cheers

I was sick in my tea when I was reading the judgement this afternoon, and then got that familiar feeling when I read the front of the Info Brief that the Board stuck out.  They certainly like mentioning Wal's name - he deserves his own hall of fame in the Board's office - or maybe he already has it.   They have wasted our money for years.  I don't know of other charities who "compel" you to give.  The next stop has to be IRD to see if all fees and levies paid are subject to being donations and the appropriate tax rebate claimed.  I am astounded.  Now for an OIA to see exactly how much practitioner money they spent fighting the original judgement.

On what planet are they a charity ::)....if you have money (sadly ours) you can buy any result you like, bit OJ Simpsonesque, so they are tax exempt and they have had a law retrospectively changed to be able to tax us.....one rule for us and no feckin rules for them.

Again we played them on their pitch with their ref and their selective rule book.....surprise surprise we got shafted.

We need to take it to a place outside of their influence and control or we will never get anywhere.

Just before it awards them their appeal, it ironically specifically talks about gas explosions.....but they have got off scot free about what they did in my situation, total bullshit.

Charity.....perhaps in a few years they can hand out food parcels and blankets for plumbers who can't pay their mortgages.

I'm definitely claiming tax credits on this.  A charity is a charity. I am helping a charity protect the health of vunerable new zealanders nationwide. The Board have claimed this themselves. That now entitles me to claim the entitled tax credits (formerly rebate).  The PGDB is obviously not on the approved donee organisations list, and I bet they arent going to be either as the whole thing is a stitch up. How do we get around this?

According to the IRD website if we wish to claim we must have a receipt with the name of the donor, amount and date of donation, a clear statement that it is a donation, signature of authorised person and an "official" stamp with the name of the approved donee organisation but since the board is not on the list on IRD's website  how can we legally do it??

Definitely need to ask them about this. I will be ringing them up next week. And the Board will get an ear full if it turns out they get to be a charity but we can't claim rebates. If they eventually wish to get their terrace offices raided by a partisan army of aggressive plumbers, gasfitters and drainlayers, complete with violence and all the usual etc they are making all the right moves. Next will be house arrest sentances in the local district courts for those that fail the coming audits. Or are caught unlicensed.

hi, guys, yes rodza i have had a look at the charities web site too and like all govt dept information it is difficult to decifer it properly, you need a lawyer to explain it, no doubt the Federation will look into it, in fact the federation could probably register as a charity to some advantage. in fact could we all register ourselves as charities as we are upholding the health and safety of nz by being licenced then pay no tax on our earnings/donations,cheers

Look at the bright side.  We can nominate each other for the Queens honours list for devoted service to a charity.  Someone with 30 Plus years in the industry has done a lot of good. Who wants to put me forward I've done nearly 40years.
