Consultation on the proposal to prescribe participation in competence reviews as a standard term and condition of a licence
The Board is now consulting on its proposal to prescribe by way of Gazette notices, that any tradesperson requested by the Board to participate in a competence review, must do so as a standard term and condition of a licence. To find out more about this proposal and how to make a submission please read the submission booklet.
The Board invites submissions on its proposal which is now available online for public consultation. Please note submissions close at 5pm on 17 May 2013.
Section 53 of the Act gives the Board the authority to review a registered person’s competence at any time, whether or not there is reason to believe that the person’s competence may be deficient.
At its meeting on 25 June 2013, the Board will consider submissions received. It will then decide whether to proceed with prescribing by way of Gazette notices, participation in competence reviews as a standard term and condition of a licence.

Hi guys, will there be no end to this constant fiddling of the rules that govern our trades? Another consultation that seems to want to create an atmosphere of fear so as to let this `out of control` board dream up new ways of controlling and ripping us off. In my opinion the Govt needs to take urgent action against this board, if the board has no other business apart from dissecting the act for the purpose of extracting more money from an already over regulated/over charged industry then I believe that it should be disbanded.  cheers

This Board have not learnt anything from the past couple of years.  Here again I believe they are acting ultra vires - giving themselves power that the Act does not confer.  They do not NEED to do a Gazette notice.  The legislation allows them to do a competency audit where they have grounds - but that is the key, they must have grounds - and there is a set process they must follow.  I suspect the example they give where someone refused to undertake the audit was a case I heard about - and it was one where the Board did not follow the process i.e. they did not write to the practitioner laying out the grounds and give that practitioner the right to reply in writing - so he refused to take part.  The conspiracy theorist in me thinks it is personal - that the Board are f**ked off with the Federation for exposing their incompetence over and over and want to shove it up them.  They trot out "the health and safety of the public" as the excuse every time they cock up.  They have been proven over and over to be wrong, and now they are going at it hammer and tongs again.  When will they learn.  Why aren't they TALKING to industry first to discuss this - why go head long into a Gazette Notice?  This isn't consultation - this is a do you agree or not, but we are going to do it anyway. Consultation is when you ask, or are open to other ideas - not here it is, yes or no.  Minister Williamson needs to take this Board in hand before they create such a problem that no one licences.  Speaking of which I believe the numbers are very high of practitioners who have not licensed.  I suspect they are all waiting for the bill to come in the mail - that or they don't have enough points.  What is the Board going to do then?  How will they handle large non-compliance in the sector.   I suspect that in the past week only maybe 1000 peple should have been working in the industry - the rest should be at home until they have their licence.

Perhaps they might have some sympathy if they actually audited those tradespeople that are known to do dodgy  work eg Badgers old boss, Several others from the same situation I could name. (one blamed and another did the work). I can see this being a huge problem. The Boards members mates will be ringing up with their oppositions details so that their competition is reduced.

Enough is enough. If the Board wants a fight then they shall have one. 

We need to pull finger out and help the Federation committee.  How about we hit the phone book and start recruiting for the Federation or fundraising as I'm sure the committee is busy enough fighting the fight. Perhaps we can do some Federation Tee Shirts. Any budding artists out there that can design something humorous.   

Anyone got any ideas like making some Williamson and Bickers INaction toys that you can stick pins in.  Check those ideas in and lets take action.

To change the subject a bit I heard a rumour that the Board have installed Bomb blast doors.

If they are here for the H&S of the NZ Public why haven't they gone after the person responsible for the exploding chip shop or the house that has the same water coming out of the hot taps and shower, that just spent the summer sat in the Radiators on a central heating system, all installed by my old boss and he is being protected by them to this day.

I KNOWthat they are selective on who they go after, they will go you if it suits them regardless of evidence, the truth or ethics......

In 10 years time they will have a monopoly and if people think a plumber is expensive today.....well how does $200 per hour sound, because only them, their cronies and all suck ups will be legally licensed to work......

This will be a legal witch-hunt, mark my words.

Actually Watchdog I did hear that they had installed some hefty security at the Board offices. Surely they won't have spent out money on shit like that?  This must be a joke?  What do they think we are, the IRA?   Hells bells, if it is true then someone should have to answer for such wanton expenditure... 

I like the idea of everyone taking some responsibility to recruit or fundraise.  If this Amenment bill goes through then i presume there will be some legal action to follow - all of which will cost pingers.  I know the executive committee are very busy, and they have day jobs as well. 

I'm doing what I can to sign people up.

We can all rest assured that the Board wont miss any opportunity to gather revenue and this is a golden opportunity to do so. In fact, the whole idea is probably founded upon the increase in revenue

Wow, as if shit cant get any worse, I stand corrected. This is the biggest crock of shit ever. Anyone who thinks they already dont have a hit list of "persons of interest" aka federation members they want to wipe out is naive. I agree with Jax, this will go through more or less. They only ask for submissions to appear to be seen to be consulting on the matter when in fact they have already decided they will implement it. They may have already decided on the fee they will impose for this audit. Could be $300 who knows but them. This will help drive up federation support, no doubt about that. 

They will target those that cause them the most trouble. Most born and bred Master Plumbers would be safe I'd say. Wal will be at the top of their hit list. " Public Enemy Number 1" except he's not John Dillenger and hes not a bank robber, just a plumber that seeks a fair and honest industry regulator.

What they may do is make audits impossible to pass for those that give them problems but easy for those that support them. It would be hard and take time to catch them out with this.

I thought the Board was corrupt before but this has blown my mind.

No one holds up banks anymore, as you get shot at and eventually caught and go to jail. Crime has evolved with the times.What you do these days is put on a suit, tell everyone that you are very important, you go to your "office" complete with high level security and legitimately bend and twist laws to defraud blue collar workers by wielding all powerful 'legislation' instead of a sawn off shotgun.

New York/New Jersey mafia use to do it with trade unions for tens of thousands of blue collar dock workers etc. Difference is the "Board" have back up @ govt level as well as an Act to fall back on. The American Mafia's could learn a thing or two from "The Board" here.

They may employ one for all us, or a team, and just change their job title to "auditor" when it should be hitman. They can get more of their mates into cushy high level employment  this way and charge us a boat load of money all in the name of health and safety. I bet they started dreaming this up as soon as they realised theyd lost the gas cert revenue.

They will cruise the countryside failing people and getting even  richer.

As far a monitoring goes, I believe they watch us on here.

Even now, every post.

They keep referring to us as a small group, perhaps they see that only the regulars comment  here on this forum against the Board so they may think us a small band of malcontents like flip flop the fat ass keeps saying.

Who knows they may eventually bring the GCSB against us as it may soon be lawful to spy on any person in NZ. "The public's health and safety was at risk, so spying was necessary etc"

I can see the future head line now. "Rogue Plumbers spied on by GCSB"
